What is stamp duty and why is it state-wise?
Stamp duty is a tax levied by state governments on legal documents — most commonly the sale deed of immovable property. The Indian Constitution puts stamp duty on most documents in the State List, so each state sets its own rate.
Rates typically range from 3% to 8% of property value, plus a separate registration charge of 0.5-4%.
How does the female-buyer discount work?
Many states offer a discount when the buyer is female, to encourage women's property ownership:
- Delhi: 4% (female) vs 6% (male)
- UP: 6% vs 7% (capped to ₹10L property value for the discount)
- Punjab: 5% vs 7%
- Rajasthan: 4% vs 6%
- Haryana: 3% vs 5%
- Bihar: 5.7% vs 6%
For joint registration with at least one female owner, most discount-states give the female rate. States with no gender-based discount (Maharashtra, Karnataka, Telangana, Tamil Nadu) charge the same regardless.
What's the registration charge?
The registration charge is a separate fee paid to register the sale deed with the sub-registrar. Typical rates:
- 1% of property value (most states)
- 0.5% in Telangana
- 2% in Kerala, Bihar, Odisha
- 3-4% in Madhya Pradesh, Tamil Nadu, Puducherry
Many states cap the registration charge: Maharashtra ₹30,000, Haryana ₹15,000, Karnataka ₹15,000.
Can I claim stamp duty as a tax deduction?
Yes — under Section 80C of the Income Tax Act, stamp duty + registration charges paid on a residential property are eligible for deduction in the year of payment, within the overall ₹1,50,000 80C limit.
Available only under the Old Tax Regime. Not in the New Regime (FY 2026-27).
What about TDS on property purchase?
Separately, if the property value is ≥ ₹50 lakh, the buyer must also deduct 1% TDS under Section 194IA at the time of payment to the seller, and deposit it via Form 26QB. Use the GSTBox TDS Calculator for that.
